This page sets out the disclaimers and limitations of liability that apply to WP Media Cloud, wpmediacloud.com, and all related services provided by Nahnu Fitness LLC, a Washington State limited liability company trading as Nahnu Plugins ("we," "us," or "our").
These disclaimers apply in addition to the warranty disclaimers and liability limitations set out in our Terms of Use. In the event of any conflict, the Terms of Use shall prevail.
1. No Warranty
WP Media Cloud is provided on an "as is" and "as available" basis without any warranty of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
- Warranties that the plugin will meet your specific requirements or expectations;
- Warranties that the plugin will be uninterrupted, error-free, secure, or free from bugs, viruses, or other harmful components;
- Warranties regarding the accuracy, reliability, completeness, or timeliness of any output produced by the plugin;
- Warranties that defects or errors in the plugin will be corrected within any particular timeframe or at all.
Your use of WP Media Cloud is entirely at your own risk. You are responsible for ensuring the plugin is suitable for your intended use before deployment.
2. Data Loss Disclaimer
WP Media Cloud interacts directly with your WordPress media library and cloud storage providers. While we have designed the plugin to operate safely, we expressly disclaim all liability for any loss, corruption, deletion, or inaccessibility of data, files, or media arising from:
- Use of the bulk offload, bulk download, or migration tools;
- Misconfiguration of storage provider credentials, bucket permissions, or CDN settings;
- Actions taken by third-party cloud storage or CDN providers, including service outages, account suspensions, or changes to their APIs;
- Plugin conflicts with other WordPress plugins, themes, or server configurations;
- WordPress core updates, server environment changes, or hosting provider actions that affect plugin behaviour;
- Any failure, interruption, or error in our update server or license validation system.
We strongly recommend that you maintain independent backups of all media files before using any bulk operation feature of WP Media Cloud. Taking a full site backup before running bulk offload, bulk download, or migration is your responsibility and is not performed automatically by the plugin.
3. Third-Party Services Disclaimer
WP Media Cloud integrates with third-party cloud storage providers, CDN networks, image optimizers, page builders, and other services. We have no control over these services and disclaim all liability for:
- The availability, performance, reliability, or security of any third-party service;
- Changes to third-party APIs, pricing, terms of service, or feature sets that affect how WP Media Cloud operates;
- Data breaches, outages, or data loss occurring at or caused by a third-party provider;
- Fees, charges, or penalties imposed by a third-party provider as a result of your use of their service through WP Media Cloud;
- Account suspensions or terminations by a third-party provider due to your usage patterns or violation of their terms.
You are solely responsible for reviewing and complying with the terms, acceptable use policies, and pricing of any third-party service you connect to WP Media Cloud. We do not act as a reseller, agent, or guarantor for any third-party service.
4. Website and Content Disclaimer
The information published on wpmediacloud.com, including documentation, tutorials, blog posts, and feature descriptions, is provided for general informational purposes only. We make no representations or warranties regarding the accuracy, completeness, or currency of this information.
- Information on this website may be out of date or may not reflect the current version of the plugin;
- Feature descriptions are subject to change without notice as we update and improve the plugin;
- Pricing information is subject to change and the current prices displayed at checkout prevail over any prices mentioned elsewhere on the site;
- Nothing on this website constitutes legal, financial, technical, or professional advice. You should seek independent professional advice before making decisions based on information found here.
5. Compatibility Disclaimer
WP Media Cloud is designed to work with supported versions of WordPress, supported page builders, supported storage providers, and supported plugin integrations listed on this website. We do not warrant and expressly disclaim liability for:
- Compatibility with WordPress versions, plugins, themes, or server environments not explicitly listed as supported;
- Compatibility with future versions of WordPress, PHP, or any third-party plugin or service following their update;
- Conflicts arising from customisations to your WordPress installation, non-standard server configurations, or use of the plugin in conjunction with unsupported software;
- Performance degradation, increased server load, or hosting-related issues arising from use of the plugin.
We recommend testing WP Media Cloud in a staging environment before deploying it to a live production site. We provide a health check tool within the plugin to help verify your configuration before going live.
6. Security Disclaimer
While we apply reasonable security measures to the plugin code and our website, we do not warrant that WP Media Cloud or wpmediacloud.com is free from security vulnerabilities. We disclaim all liability for:
- Security vulnerabilities in the plugin that arise after its release;
- Security breaches resulting from misconfigured storage credentials, publicly accessible buckets, or improper server configurations on your part;
- Unauthorised access to your cloud storage or CDN account credentials that you provide to the plugin;
- Security incidents affecting your WordPress installation, hosting environment, or third-party services that impact how the plugin operates.
You are responsible for securing your WordPress installation, keeping the plugin updated, using strong credentials for your cloud storage accounts, and following the security best practices of your hosting provider and cloud storage provider.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Nahnu Fitness LLC, its members, managers, employees, contractors, or agents be liable to you or any third party for any:
- Loss of data, media files, revenue, profits, business, goodwill, or anticipated savings;
- Indirect, incidental, special, consequential, exemplary, or punitive damages;
- Business interruption or loss of business opportunity;
- Costs of substitute goods or services;
- Damage to reputation or loss of customers.
This limitation applies whether the claim arises in contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or relating to WP Media Cloud shall not exceed the greater of: (a) the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred United States dollars (USD $100).
Some jurisdictions do not permit the exclusion or limitation of certain damages. In those jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
8. Indemnity
You agree to indemnify, defend, and hold harmless Nahnu Fitness LLC and its members, managers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of WP Media Cloud;
- Your breach of our Terms of Use, this Disclaimers page, or our Acceptable Use Policy;
- Your violation of any applicable law or the rights of any third party;
- Any content, data, or media you store, transmit, or serve using the plugin;
- Your configuration of or interaction with any third-party service connected through the plugin.
9. No Professional Advice
Nothing on wpmediacloud.com or in the WP Media Cloud documentation constitutes legal, financial, accounting, tax, or professional advice of any kind. Any information provided is for general informational purposes only and does not create any professional relationship between you and Nahnu Fitness LLC.
You should always seek qualified professional advice before making decisions that may have legal, financial, or technical consequences.
10. Changes to These Disclaimers
We may update these disclaimers at any time. We will update the "Last updated" date at the top of this page when changes are made. Your continued use of WP Media Cloud after any change constitutes your acceptance of the updated disclaimers.
